What Other Solutions are Available?

If you wish to have a decision of the Refugee Appeal Division (RAD) reviewed at the next level, you may be eligible to apply for leave and judicial review at the Federal Court of Canada. There are strict criteria to be able to do so, but it is critical to assess this option.

While it is possible to self-represent during this process, it is important to remember that the process requires a high level of organization and effort.  It is both challenging and highly technical. You will need to decide whether you are capable of meeting these demands by yourself.

Like all levels of tribunal and court in Canada, you have the right at Federal Court to be represented by a lawyer to help you through this process.
